Baldoni immediately filed a counter lawsuit accusing Lively and her husband Ryan Reynolds of defamation, invasion of privacy and extortion. He is also suing <em>The<\/em> <em>New York Times<\/em>, which published Lively\u2019s account, for up to $250 (\u00a3192.8m) for libel, claiming it relied on his co-star\u2019s \u2018unverified and self-serving narrative\u2019.<\/p>\n<p>It has become near impossible to avoid details about the case, which gets messier each week, but there is no doubt endless social media speculation has shaped public opinion at various junctions. This is something both parties have been affected by.<\/p>\n<p>At the end of January, Baldoni kept his promise to publish his lawsuit on a website that is publicly available to read, in the hope of clearing his name. Lively then submitted a request to the judge that certain discoveries made in the case be for their \u2018attorneys\u2019 eyes only\u2019 to protect against any leaks of sensitive information.<\/p>\n<p>\u2018There is an insatiable appetite for any information about this case, no matter how benign it is,\u2019 Lively\u2019s attorney, Meryl Governski, told the New York Judge Lewis Liman this month. \u2018The defendants have bragged in text messages about being able to publish information without fingerprints.\u2019<\/p>\n<p>Governski added that all information related to medical information, including mental health, should be kept between lawyers and that \u2018personal and intimate conversations with unrelated third parties\u2019 should be kept out of the public eye because the evidentiary value would be \u2018virtually non-existent\u2019.<\/p>\n<p>Liman ruled in favour of Lively\u2019s request last week, agreeing that \u2018highly personal and intimate information about third parties\u2019 will only be seen by lawyers. This also means that neither Lively not Baldoni will have access to the information, which includes details about medical records, trade secrets and security measures. The judge said that \u2018the risk of disclosure is great\u2019 and could lead to further \u2018gossip and innuendo\u2019 online.<\/p>\n<p>[\/et_pb_text][et_pb_text module_class=&#8221;custom-quote&#8221; _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; header_2_font=&#8221;Libre Bodoni|||on|||||&#8221; header_2_text_align=&#8221;center&#8221; header_2_text_color=&#8221;#333333&#8243; header_2_font_size=&#8221;40px&#8221; header_2_line_height=&#8221;1.2em&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2 class=\"p1\">&#8216;There is an insatiable appetite for any information about this case&#8217;<\/h2>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.20.4&#8243; _module_preset=&#8221;default&#8221; hover_enabled=&#8221;0&#8243; global_colors_info=&#8221;{}&#8221; sticky_enabled=&#8221;0&#8243;]<\/p>\n<p>While Baldoni\u2019s lawyers did not object to certain material being kept from the public, they argued that being unable to share findings with their clients would make it difficult to litigate the case and potentially lead both sides to raise additional legal arguments.<\/p>\n<p>Liman therefore limited the \u2018attorneys\u2019 eyes only\u2019 material to information that was \u2018highly likely to cause significant business, commercial, financial or privacy injury\u2019, adding that confidentiality would speed up the discovery process.<\/p>\n<p>It is difficult for anyone following the case from afar to fully understand the impact viral stories, leaked messages and thousands of TikTok verdicts might be having on both Lively and Baldoni. Lively claims she has received \u2018violent, profane, sexist and threatening communications\u2019 in recent months because of how much information about the case has been made available to the public.<\/p>\n<p>Baldoni\u2019s published lawsuit contains private text messages between Lively and Baldoni, many of which allegedly contradict some of the claims in her original lawsuit. Others messages have gone viral for different reasons, with one exchange about Lively\u2019s \u2018mega celebrity friend\u2019 causing a particular stir online. In the messages Lively refers to her friend, widely thought to be Taylor Swift, as \u2018one of her dragons\u2019. She told Baldoni, \u2018My dragons also protect those I fight for. So really we all benefit from those gorgeous monsters of mine.\u2019\u00a0<\/p>\n<p>There is no doubt that the publication of such details is an invitation for the public to form an opinion on the situation. Baldoni\u2019s legal team has therefore accused Lively of trying \u2018to shield from public view documents and information exchanged herein\u2019 for the sake of her reputation. \u2018Given how actively the Lively Parties have publicised and litigated Ms Lively\u2019s claims in the media, we are surprised to now learn how vehemently she wants to prevent the public from accessing material and relevant evidence,\u2019 Baldoni\u2019s team wrote to the judge.<\/p>\n<p>It&#8217;s true that Lively\u2019s lawsuit was first reported on by <em>The New York Times,<\/em> catapulting the otherwise forgotten \u2018<em>It Ends With Us<\/em> cast drama\u2019 back into the public domain. Not only that, but Baldoni has also accused Reynolds of using the character of Nicepool \u2013 a faux feminist with a man bun who is sexist towards Lively\u2019s Ladypool character \u2013\u00a0in <em>Deadpool &amp; Wolverine<\/em> to intentionally mock him in public.
